These Terms & Conditions apply when you use www.nogginhelmets.com.au (the Website) or purchase products from us.
The Website and Noggin Helmets are operated by Coastie Bikes Pty Ltd (ABN 28 684 856 193), trading as Noggin Helmets (Noggin, we, us or our).
By placing an order, you agree to these Terms & Conditions. Please also read our Shipping & Returns, Size Guide & FAQs, Safety information and Privacy Policy.
Nothing in these Terms & Conditions excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
1. Who can place an order
You must be at least 18 years old and legally capable of entering into a contract to place an order. If you are under 18, an adult parent or guardian must place the order for you.
You must provide complete and accurate information when ordering, including your name, contact details and delivery address. Please check your order carefully before submitting it.
2. Products, sizing and safety
We take reasonable care to ensure that product descriptions, images, prices and availability shown on the Website are accurate. Colours and other visual details may vary slightly depending on your screen and between production batches. Any variation will not affect your rights where a product does not match its description.
Noggin helmets are protective products and must fit correctly to perform as intended. Before ordering, measure the child's head and review our Size Guide & FAQs. Age ranges are a general guide only; head circumference and correct fit are the more reliable measures.
You are responsible for ensuring that the helmet is correctly fitted and adjusted before each use. An adult should read and follow all instructions and warnings supplied with the product, supervise its use where appropriate, inspect it regularly, and stop using it if it has been involved in an impact or shows signs of damage. Do not alter the helmet or use it in a way that is inconsistent with the supplied instructions.
A compliant bicycle helmet is designed to reduce the risk of injury, but no helmet can prevent every injury. The removable bucket hat is an accessory only. It is not protective equipment and is not independently certified as a safety device. The certified bicycle helmet worn underneath provides the protective function.
3. Orders and acceptance
When you submit an order, you are offering to purchase the selected products on these Terms & Conditions. An automated order acknowledgement confirms that we have received your order; it does not necessarily mean that we have accepted it.
Your order is accepted and a contract is formed when we send you a dispatch confirmation, unless we expressly accept it earlier. Products remain subject to availability until then.
Before dispatch, we may decline or cancel an order where:
a product is unavailable;
there is an obvious error in the product description, price or promotion;
we cannot verify or authorise payment;
we reasonably suspect fraud or unauthorised activity; or
we cannot deliver to the address provided.
If we cancel an order after taking payment, we will notify you and provide a full refund to the original payment method. We will not charge you a different price without first giving you the choice to confirm the order at the correct price or cancel it for a full refund.
4. Prices and payment
All prices are displayed in Australian dollars. Coastie Bikes Pty Ltd is not currently registered for GST, so GST is not charged. Delivery charges are shown before purchase.
We may change prices at any time, but a price change will not affect an order we have already accepted, except where you agree to correct an obvious pricing error before dispatch.
Payment must be made using one of the methods available at checkout. Payments are processed by our payment provider. Your payment may be subject to the provider's own terms and security checks.
5. Promotions and discount codes
Promotions and discount codes may be subject to additional conditions stated at the time of the offer. Unless otherwise stated, a discount code:
may be used only once per customer;
cannot be exchanged for cash;
cannot be applied retrospectively; and
cannot be combined with another offer.
We may change or end a promotion prospectively, but this will not affect an order already accepted. Promotions do not limit your rights under the Australian Consumer Law.
6. Shipping and delivery
We currently deliver within Australia unless another destination is made available at checkout.
Orders are generally dispatched within 1–2 business days. Delivery within Australia usually takes a further 2–7 business days, depending on the destination. These timeframes are estimates rather than guaranteed delivery dates. We will provide tracking details when available.
Shipping charges are calculated at checkout. We currently offer free standard shipping on orders over $100 AUD, subject to any conditions displayed on the Website at the time of purchase.
You are responsible for checking that the delivery address is correct. If an order is returned because the address supplied was incorrect or the parcel was not collected, we may ask you to pay the reasonable cost of redelivery. This does not apply where the problem was caused by us or our delivery provider.
If an order is delayed, lost or damaged in transit, please contact us so we can investigate and provide any remedy required by law. If we become aware that we cannot supply your order within the stated or a reasonable time, we will contact you with an update and the available options, which may include a replacement or refund.
Risk in a product passes to you when it is delivered to the address you nominated, or otherwise delivered in accordance with delivery instructions you authorised. Ownership passes to you once we have received full payment.
7. Change-of-mind and fit returns
In addition to your rights under the Australian Consumer Law, we offer a 30-day return policy if you change your mind or the helmet does not fit.
To qualify for a change-of-mind or fit return, the product must be returned within 30 days of delivery and must be:
unused;
in its original condition; and
in its original packaging.
Email info@nogginhelmets.com.au with your order number before sending the product back. You are responsible for arranging and paying for return delivery for a change-of-mind or fit return. We recommend using a tracked service, as you remain responsible for the product until it reaches us.
Once the return is received and checked, we will refund the eligible product price to the original payment method. Original delivery charges and return delivery costs are not refundable for change-of-mind or fit returns unless required by law. Exchanges are subject to product availability.
We may decline a voluntary change-of-mind return that does not meet the conditions above. These conditions do not apply to a product that is faulty, unsafe, damaged, incorrectly supplied or otherwise fails to meet a consumer guarantee.

8. Faulty, damaged or incorrect products
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. They must be of acceptable quality, be fit for any purpose made known to us, match their description and satisfy the other applicable consumer guarantees.
If a product has a major problem, you are entitled to choose a refund or replacement. If the problem is minor, we may choose to provide a repair or another remedy permitted by the Australian Consumer Law. If a minor problem cannot be fixed within a reasonable time, you may be entitled to a replacement, refund or other remedy. You may also be entitled to compensation for reasonably foreseeable loss or damage caused by a failure to meet a consumer guarantee.
Please contact us as soon as reasonably possible if your order arrives damaged or incorrect—ideally within seven days—so we can investigate promptly. This request does not impose a time limit on your rights under the Australian Consumer Law.
We may ask for proof of purchase and information or photographs that reasonably help us assess the issue. You have the right to return a product you believe has a problem, and original packaging is not required for a return made under the Australian Consumer Law.
Where a product is confirmed to be faulty, damaged in transit or incorrectly supplied, we will cover or reimburse reasonable return delivery costs and provide the remedy required by law. Please contact us before returning the product so we can give you the appropriate instructions.
Unless you agree otherwise, an approved refund will be returned to the original payment method. Bank and payment-provider processing times may apply after we issue the refund.

9. Website use
You may use the Website for lawful personal purposes. You must not:
misuse the Website or use it for unlawful or fraudulent activity;
interfere with the Website's operation or security;
attempt to gain unauthorised access to the Website, customer accounts or related systems; or
introduce malicious code or use automated means to extract Website content without our permission, except as permitted by law.
We may restrict access where reasonably necessary to protect the Website, our customers or our business. We do not guarantee that the Website will always be available or free from errors, but this does not affect any rights relating to an order already placed.
10. Intellectual property
The content on the Website—including text, graphics, logos, photographs, video, product names and Website design—is owned by or licensed to Noggin and is protected by intellectual property laws.
You may view and use the Website for your own personal, non-commercial purposes. You must not reproduce, distribute, modify, publish or commercially exploit Website content without our prior written permission, except where permitted by law.
11. Third-party services and links
The Website may use or link to third-party services, including payment, delivery and social-media services. We are not responsible for third-party websites that we do not control. Your use of a third-party service may also be subject to that provider's terms.
This section does not limit our responsibility for the products we sell, the delivery services we arrange, or any other obligation that cannot lawfully be excluded.
12. Privacy
We handle personal information in accordance with our Privacy Policy and applicable privacy laws.
13. Liability
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
To the extent permitted by law, we are not responsible for loss or damage to the extent it is caused by incorrect fitting, use contrary to the supplied instructions or warnings, unauthorised alteration, continued use after an impact or visible damage, or another act or omission outside our reasonable control.
To the extent permitted by law, neither party is liable to the other for loss that was not reasonably foreseeable when the contract was formed. This does not limit any right to compensation available under the Australian Consumer Law.
14. Events outside reasonable control
Sometimes an event outside our reasonable control may delay or prevent us from fulfilling an order. If this happens, we will take reasonable steps to minimise the disruption and contact you where the delay is material.
This section does not remove your rights if we cannot supply a product on time or within a reasonable time. Where appropriate, we will offer the options required by law, which may include a replacement or refund.
15. Changes to these terms
We may update these Terms & Conditions from time to time to reflect changes to our products, Website, business practices or legal obligations. The updated terms will be published on this page with a revised “Last updated” date.
The terms that apply to an order are those available when you place that order. We will not apply a later material change retrospectively to an accepted order without your agreement, unless required by law.
16. General
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions continue to apply.
If we do not immediately enforce a provision, this does not mean we waive our right to enforce it later.
These Terms & Conditions are governed by the laws of New South Wales and the Commonwealth of Australia. Nothing in this section limits any right you have to bring a claim in another jurisdiction where applicable law permits.
